Terms of Service
Effective Date: January 8, 2025
Please read these Terms of Service ("Terms") carefully before using AtlasEQ. These Terms constitute a legally binding agreement between you and AtlasEQ, a company established in Paris, France, governing your access to and use of our website, desktop application, and related services.
Consumer Notice: If you are a consumer within the meaning of French and EU law, your statutory rights remain unaffected by these Terms. Nothing in these Terms limits or excludes mandatory consumer protections.
1. Acceptance of Terms
By accessing or using AtlasEQ, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.
If you are using AtlasEQ on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
2. Service Description
AtlasEQ is a professional equity research platform that provides:
- Financial data aggregation from official regulatory sources (SEC EDGAR, ESEF, FRED, World Bank, and others)
- Technical and fundamental analysis tools
- Charting and visualization capabilities
- Research note organization and documentation
- Portfolio tracking and watchlist management
AtlasEQ is a software tool designed to assist with financial research. It aggregates publicly available data and provides analytical tools, but does not provide personalized financial advice.
3. Pre-Launch Program & Waitlist
IMPORTANT: AtlasEQ is currently in pre-launch development. The following terms apply to our waitlist and pre-launch program:
3.1 Launch Timeline
Any launch dates or timelines mentioned on our website, communications, or marketing materials (including but not limited to "2026/2027") are estimates and goals only, not commitments or guarantees. AtlasEQ reserves the right to modify, delay, or adjust the launch timeline at its sole discretion without prior notice or liability.
3.2 Waitlist Participation
Joining our waitlist:
- Does not guarantee access to AtlasEQ upon launch or at any time
- Does not create any contractual obligation for us to provide you with the software
- Does not entitle you to any specific features, pricing, or early access benefits
- May be terminated at our discretion at any time
3.3 No Liability for Delays
AtlasEQ shall not be liable for any delays in launching the service, changes to planned features, modifications to pricing, or any other changes to the product or service. You acknowledge that software development timelines are inherently uncertain and agree not to hold AtlasEQ responsible for any delays or changes.
3.4 Pre-Launch Communications
By joining our waitlist, you consent to receive communications regarding AtlasEQ's development progress, launch updates, and related information. You may unsubscribe from these communications at any time.
4. Eligibility
To use AtlasEQ, you must:
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our services under applicable laws
- Provide accurate and complete registration information
AtlasEQ is intended for use by individuals with financial knowledge and experience. If you are not familiar with financial markets and investment concepts, you should seek professional guidance before making investment decisions.
5. Account Registration
5.1 Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as necessary
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access
5.2 Account Responsibility
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
5.3 One Account Per User
Each user may maintain only one account. Creating multiple accounts to circumvent restrictions or abuse promotions may result in termination of all accounts.
6. Subscriptions & Billing
6.1 Plans and Pricing
AtlasEQ offers various subscription plans as described on our Pricing page. Prices are subject to change with reasonable notice to existing subscribers.
6.2 Demo Access
We may offer limited demo access to allow you to explore the platform before subscribing. Demo access is provided at our discretion and may be limited in features, duration, or data access.
6.3 Billing
- Paid subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable
- You authorize us to charge your payment method for all applicable fees
- Failed payments may result in suspension of your account
6.4 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You retain access until the end of your current billing period
- No refunds are provided for unused time
- Your data remains accessible for 30 days after expiration
7. License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the AtlasEQ desktop application on devices you own or control
- Access and use the services for your personal or internal business purposes
- Use the data and analysis tools provided through the platform
This license does not include the right to sublicense, resell, or distribute AtlasEQ or any data obtained through the platform.
8. Restrictions
You agree not to:
- Reverse Engineer: Decompile, disassemble, or attempt to derive the source code of the software
- Modify: Create derivative works based on the software
- Redistribute: Sell, resell, rent, lease, or commercially distribute the software or access
- Circumvent: Bypass or attempt to bypass any access controls or usage limits
- Scrape: Use automated systems to extract data beyond normal application usage
- Misrepresent: Falsely claim affiliation with AtlasEQ or use our branding without permission
- Illegal Use: Use the service for any unlawful purpose, including market manipulation or fraud
- Interfere: Attempt to disrupt or compromise the integrity or performance of our systems
9. Financial Data Disclaimer
IMPORTANT: The financial data displayed in AtlasEQ is sourced from third-party providers including government regulatory agencies (SEC, FRED), international organizations (World Bank, IMF), and other official sources.
While we strive to display accurate information, AtlasEQ does not guarantee the accuracy, completeness, timeliness, or reliability of any data. Data may contain errors, omissions, or delays introduced at the source or during processing.
You acknowledge that:
- Financial data should be verified independently before making decisions
- Historical data may be restated or corrected by original sources
- Real-time data may be delayed and should not be relied upon for time-sensitive decisions
- Calculated metrics (ratios, indicators) are derived from source data and inherit any underlying errors
AtlasEQ is not responsible for any losses resulting from reliance on data displayed in our platform.
10. Not Investment Advice
AtlasEQ does not provide investment advice, financial advice, trading advice, or any other form of professional advice.
The information and tools provided through AtlasEQ are for informational and educational purposes only. Nothing in our platform constitutes:
- A recommendation to buy, sell, or hold any security
- An offer or solicitation to purchase or sell securities
- Personalized investment advice based on your circumstances
- Tax, legal, or accounting advice
Investment decisions should be made based on your own research, financial situation, risk tolerance, and consultation with qualified professionals. Past performance is not indicative of future results. All investments involve risk, including the potential loss of principal.
You are solely responsible for your investment decisions.
11. Intellectual Property
11.1 Our Property
AtlasEQ, including its software, website, design, logos, and documentation, is owned by AtlasEQ and protected by intellectual property laws. All rights not expressly granted in these Terms are reserved.
11.2 Third-Party Data
Financial data displayed in AtlasEQ is owned by the respective data providers (SEC, Federal Reserve, World Bank, etc.). Your use of this data is subject to any applicable terms from these providers. You may not redistribute, sell, or commercially exploit data obtained through AtlasEQ.
11.3 Feedback
If you provide suggestions, feedback, or ideas about our services, you grant us a perpetual, royalty-free license to use such feedback without obligation to you.
12. User Content
AtlasEQ allows you to create and store content such as research notes, watchlists, and portfolio data ("User Content").
12.1 Local Storage
Your User Content is primarily stored locally on your device. We do not automatically access, view, or process your User Content.
12.2 Your Responsibility
You are responsible for maintaining backups of your User Content. We are not liable for any loss of User Content due to device failure, software issues, or other causes.
12.3 Support Access
If you choose to share User Content with us for support purposes, we will use it only to assist you and will not retain it longer than necessary.
13. Third-Party Services
AtlasEQ integrates with and relies on third-party services:
Data Sources
We aggregate data from official sources including SEC EDGAR, FRED, World Bank, and others. These sources have their own terms of use and may modify or discontinue data availability.
Payment Processing
Payments are processed by third-party providers. Your payment information is handled according to their terms and privacy policies.
We are not responsible for the availability, accuracy, or performance of third-party services. Changes to third-party services may affect AtlasEQ functionality.
14. Termination
14.1 By You
You may terminate your account at any time by canceling your subscription and deleting your account through the application settings or by contacting us.
14.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- You fail to pay applicable fees
- We are required to do so by law
- We discontinue the service (with reasonable notice)
14.3 Effect of Termination
Upon termination:
- Your license to use AtlasEQ immediately ends
- You must cease all use of the software
- We may delete your account data after 30 days
- Provisions that should survive termination will remain in effect
15. Disclaimers
ATLASEQ IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE EXTENT PERMITTED BY APPLICABLE LAW.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:
- Warranties of merchantability and fitness for a particular purpose
- Warranties of accuracy, reliability, or completeness of data
- Warranties of uninterrupted or error-free operation
- Warranties that the service will meet your requirements
We do not warrant that defects will be corrected or that the service is free of viruses or harmful components.
Consumer Rights
If you are a consumer under French or EU law, this disclaimer does not affect your statutory rights, including:
- The legal guarantee of conformity (garantie légale de conformité) under French Consumer Code Articles L.217-4 to L.217-14
- The warranty against hidden defects (garantie des vices cachés) under French Civil Code Articles 1641 to 1649
- Any other mandatory consumer protections under applicable law
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
AtlasEQ and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data
- Investment losses or trading losses
- Business interruption
- Loss of goodwill
Our total liability for any claims arising from these Terms or your use of AtlasEQ shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Consumer Protection
If you are a consumer under French or EU law, this limitation of liability does not affect:
- Our liability for death or personal injury caused by our negligence
- Our liability for fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under applicable law
- Your statutory rights under the French Consumer Code (Code de la consommation)
These limitations are proportionate and do not deprive you of the essential benefit of our services as required by French Civil Code Article 1170.
17. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless AtlasEQ and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your violation of these Terms
- Your violation of any third-party rights
- Your investment or trading decisions
- Any content you provide or actions you take through the services
Consumer Notice: If you are a consumer under French or EU law, this indemnification clause applies only to the extent permitted by applicable consumer protection laws. It does not require you to indemnify us for our own negligence or breach of contract.
18. Governing Law & Disputes
18.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. The provisions of French consumer law (Code de la consommation) apply where you are a consumer.
18.2 Dispute Resolution
Any disputes arising from these Terms or your use of AtlasEQ will be resolved as follows:
- Informal Resolution: We encourage you to contact us first at info@atlas-eq.com to resolve disputes informally
- Mediation: For consumer disputes, you may use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr
- Courts: If informal resolution fails, disputes will be subject to the exclusive jurisdiction of the competent courts of Paris, France
18.3 Consumer Rights
If you are a consumer (as defined by French and EU law), nothing in these Terms affects your statutory rights under applicable consumer protection laws. In particular:
- You may bring legal proceedings in the courts of your country of residence
- Mandatory consumer protection laws of your country of residence continue to apply
- You benefit from the legal guarantees provided by the French Consumer Code
18.4 Language
These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail, except where prohibited by applicable law.
19. Changes to Terms
We may modify these Terms at any time. When we make material changes:
- We will update the "Effective Date" at the top of this page
- We will notify you via email or prominent notice in the application
- Changes take effect 30 days after notification for existing users
Continued use of AtlasEQ after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the service.
20. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AtlasEQ
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- Waiver: Failure to enforce any provision does not waive our right to enforce it later
- Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights freely
- Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control
